Litigation is defined as the process of taking legal action. Litigation involves
resolving disputes in multiple forums such as, courts of law, arbitration, mediation and/or direct negotiations between the attorneys. Often disputes are resolved using more than one of these forums.
Central to all types of dispute resolution is the substantive law which governs the rights and responsibilities of the parties. Consequently, excellent research and an in depth understanding of the dispute are critical to obtaining the desired results, no matter which forum is used.
Successful litigation requires understanding of the court’s ability to grant a useful remedy. Conduct which is offensive or destructive can be stopped with injunctions.
